Frequently Asked Questions About Wills, Trusts and Estate Planning

Q. How do I know what kind of will I need?

We will choose the best will option for you, based on the information you provide.

If you are an individual or a couple with either no children or with adult children, a simple will is likely to be sufficient. If you have minor children, you would likely want a will with trust provisions. If you feel that none of these fit you, you can call us for a phone consultation with an attorney to determine the correct will solution for you.

Is this the only way I can have your office prepare a will for me?

A. No. This service is offered to provide a cost and time saving solution for those who desire a sufficient will, legally effective in Colorado.

If you have complicated circumstances or if you just want support through the process, we still prepare wills for clients by conducting a preliminary interview, preparing a draft document, and finalizing the document for your signature with proper witness.

If I fill out an on-line will application form, am I a client of Klauzer & Tremaine, llc?

A. No. You are not a “client” until you come into the office and fill out and sign a client agreement form. However, we will treat your will application form and information as “confidential” even if you do not choose to become a client.

If my spouse/partner also wants a will which will be similar to mine, does my spouse/partner have to pay the same fee?

A. In most cases there will be a discount for a second, similar will that is being prepared and signed at the same time.

What is a “Personal  Representative” and why do I need to designate a secondary person?

A. The “Personal Representative” (known in some states as the “executor”) is the person you are designating to carry out your wishes as stated in your will. We recommend that you designate a second-choice in case your first choice is unable to serve, for any reason.

When do I owe payment for the will?

A. You do not owe KT Law for your will until you make an appointment, come into the office and sign a client agreement form, and we complete your will.

How does this online will process work?

A. Instead of coming into our office for an initial interview, you provide the information to us confidentially through this website. This takes place of the initial in-office interview, saving you time and allows us to provide your document(s) at a discounted rate.

Do you still prepare wills the old-fashioned way?

A. Yes. If you want to come in for the initial interview, you are welcome to call for an appointment and we will be glad to meet with you and help you through the process to a final document.
